Responding on Jury Duty and Agoraphobia

To the average citizen, jury duty is strange territory. To the agoraphobic, everyplace that is not within his secured place is unacceptable territory. If you have agoraphobia and you received a summons for jury duty, do not feel bad if you have to come out with reasons and feel like making an excuse for not serving.



When you receive a call for jury duty, the following questionnaires would likely be furnished for your response. You do not have to be any more anxious than you already are. These questions are quite standard.



Responding to the summons:



· Are you a member of the armed forces?



· Are you a police officer or firefighter?



· Are you a U.S. citizen?



· Are you charged with or been convicted of a felony?



· Do you have a disability that would interfere with your service as a juror?



· Do you hold elected public office?



· Do you speak English?



· Have you live in this county for the past year?



· What is your age and birth date?



· What is your gender, education level and occupation?



Following that would be a space from which you are going to write your comments. In the comments section you may write any comment that you feel would interfere with your being an effective as a juror. Being agoraphobic is one of those reasons that could exempt you from the service.



The complications then would rise if you do not know yet that you have the illness but just the same are terrified of open spaces and very hesitant of venturing out of your house.



In any case, you have to assume that whatever your response may be, it would not pass the notice of the judge. The lawyers on both sides will also read your responses. The answers that you provide will be a big factor in determining whether you will be included in the final selection of jurors or not. You will also be required to phone the court (usually) within two weeks.



Standard reasons for getting out of jury duty.
Even when you do not know yet that you are suffering from agoraphobia but the symptoms are there, these could be compelling reasons why you should not be able to serve. By writing the court, you could avoid the call in process altogether.



The courts also accept the following reasons when pleading for jury duty exemption.



When you are past 70 years old.
· When you are working or are involved in the following areas: an ambulance crew member, a rescue squad member, when you have young children or elderly people to your care, or a volunteer firefighter.



· When you have a significant position in a business and that your leaving might put it at risk of failing.



· If you are a practicing professional in the following fields: lawyer, dentist, physician or a nurse.



· And if other citizens could be exempted for not having a car and are also unable to use the public transport, your condition could get an exemption for jury duty.



There are other means for getting out of jury duty but the attorneys in the courtroom (during the final selection process) will decide most of these.



If you are not comfortable with the above-mentioned reasons, or you feel that you do not fall into any of the categories for exemption, you can always ask for postponements or deferments until your condition is established or are cured.
